'Argo' finally tops box office with $12.4M

(AP) ? It took three weeks, but "Argo" finally found its way to the top of the box office.

The Warner Bros. thriller from director and star Ben Affleck, inspired by the real-life rescue of six U.S. embassy workers during the 1979 Iranian hostage crisis, made nearly $12.4 million this weekend, according to Sunday studio estimates. "Argo" had been in second place the past two weeks and has now made about $60.8 million total.

Debuting at No. 3 was the sprawling, star-studded "Cloud Atlas," which made a disappointing $9.4 million. The nearly three-hour drama, also from Warner Bros., was co-directed by siblings Lana and Andy Wachowski and Tom Tykwer and features an ensemble cast including Tom Hanks, Halle Berry and Hugh Grant playing multiple roles over six story lines.

Dan Fellman, head of distribution at Warner Bros., said the studio thought there might be a good chance of "Argo" coming out on top this weekend.

"We're thrilled. An accomplishment like that is well deserved, they don't happen very often. You would probably have to do a lot of searching to find a movie that opened in wide release to have two No. 2 weekends in a row and hit No. 1 in the third week," Fellman said. "It's a tribute to the film. Word-of-mouth has taken over the campaign. We have a long way to go, we have a lot of year-end accolades which will approach, and we'll see what happens in terms of the Academy."

On the flip side, Fellman acknowledged that "Cloud Atlas" underperformed compared to hopes that it would end up in the $11-12 million range domestically. The movie had an estimated budget of $100 million. But he pointed out that it had a higher per-screen average than any other film opening in the top 10 with $4,681.

"We did very well on the East and West coasts in a number of major cities," he said. "We're challenged in the Midwest and the South."

It was a soft weekend all around, though, with several newcomers opening poorly, Hollywood.com box-office analyst Paul Dergarabedian pointed out. The horror sequel "Silent Hill: Revelation 3-D" from Open Road Films debuted at No. 5 with $8 million and the Paramount Halloween comedy "Fun Size" arrived in 10th place with just over $4 million. "Chasing Mavericks," an inspirational surfing drama from Fox 2000, didn't even open in the top 12 ? it came in at No. 13 with $2.2 million.

The World Series might have been a factor in keeping folks away from the theaters; also, potential moviegoers along the East Coast in the path of Hurricane Sandy might have stayed home this weekend.

"The whole marketplace felt more like September than October. Back in September, we had four down weekends in a row. There was no momentum in the marketplace," Dergarabedian said. "When a holdover is No. 1, it reflects a lack of strength in the marketplace. Every week should have a new movie topping the chart."

As for the philosophical, centuries-spanning "Cloud Atlas," he said: "To have a) a big budget, b) Tom Hanks and c) it's a big, epic film, it doesn't necessarily follow that it's going to be a big box office hit. I admire that they went for it."

But there's hope on the horizon with the animated comedy "Wreck-It Ralph" coming next weekend, the latest James Bond film, "Skyfall," opening Nov. 9 and the final installment in the "Twilight" saga due out Nov. 16.

"This is just one of those box office weekends we'd rather forget," Dergarabedian said. "Unless you're 'Argo.'"

Estimated ticket sales are for Friday through Sunday at U.S. and Canadian theaters, according to Hollywood.com. Where available, latest international numbers are also included. Final domestic figures will be released Monday.

Construction jobs in Manatee still shrinking | Jobs News | Bradenton ...

MANATEE -- Construction jobs in Manatee and Sarasota have failed to respond to a recent uptick in building activity.

Despite a new housing market on pace for its best year since the crash, and commercial construction slowly rebounding, jobs in the industry continue to run at their lowest totals since the doldrums of the recession.

With the wounds of the bust still fresh, builders are hesitant to hire new workers and remain concerned about future demand.

Their payrolls reflect that.

"The recession has been so long and so deep, it's hard to change that overnight," said Charles Wilson, a commercial builder in Sarasota. "Builders are doing well, but they're not doing well enough to hire five guys or put on another crew."

Builders in Manatee alone have pulled 1,280 new residential building permits from the first of the year through Thursday -- a 28 percent jump from the same time last year, a 40 percent climb from 2010 and more than double the mark of 2009, according to the county.

The 55 new commercial building permits issued so far this year in Manatee also have gradually grown from the 23 of three years ago, records show.

While those increases hint progress, construction remains drastically scaled back from the boom days, which builders themselves say they never want to see again.

The historic crash that followed forced the sector to pause, firms to shutter and 350,000 Floridans to look for work elsewhere.

Those jobs still have not returned.

A Bradenton Herald review of labor department records show the 14,600 laborers employed in the construction industry in September were down for the same month each year dating back to at least 2009 -- when the recession had its tightest grip on the market.

And despite a 28 percent boost to residential building permits, the area still lost 300 construction jobs during the past 12 months.

In fact, employment in construction has held steady for most of the year, growing by only 200 jobs since February, the six months this year when builders have been at their busiest.

"You would think month to month, you would start to see an uptick in the numbers," said Sally Hill, spokeswoman for Suncoast Workforce, the local jobs agency. "While the number of jobs are still down, they're declining at a smaller rate ... We still haven't quite recov

ered in that industry."

Construction companies were forced to lay off so many workers during the downtown, many remain wary of hiring staff back on -- scared they will just have to go through those same painful cuts in another few years.

Some of those problems can still be evidenced today with companies like Paradise Homes, which is on the verge of collapse and may leave started homes unbuilt in Lakewood Ranch, according to company documents.

Companies have grown so accustomed to a bare-bones staff, they're having employees pick up overtime and do more with less, said Carlos Beruff, president and founder of Bradenton-based Medallion Home.

Technological advancements also have allowed builders to operate more efficiently.

Even as things pick up, builders will likely keep that efficiency going as long as they can to avoid the risk of hiring new, Beruff said.

Area homebuilder Pat Neal attributes the lull in construction employment to large-scale commercial projects such as schools, theaters and government buildings, which have been plagued by budget cuts.

Although Neal added 20 new employees this year to account for his company's record sales pace, he predicts that tally would have been higher had increasing labor taxes also not cut into the pie.

A new electronic system he installed has taken the jobs of six in the office and eight in the field.

"Until people are confident, they're holding back on hiring," Neal said. "They're taking a cautious approach."

Across the state, the 317,400 construction jobs in Florida in September were down by about 5,000 positions from a year ago. That was even after the state added 4,200 new construction jobs during the month -- largely easing the yearly loss.

Wages for those workers also remain stagnant.

General construction laborers in the Bradenton-Sarasota market earned a median salary of $11.88 an hour in 2011, the latest survey available from the labor department. In 2008, the median was $12.65.

"There's all kinds of things builders are trying to figure out to make sure they're financially healthy before they hire that new employee," Beruff said. "The bottom line is even at this hurried pace, we're only running at 20 percent of peak."

As the industry mounts gains closer to 50 percent of its boom levels, the hiring will become more evident, Beruff said.

That's a target he believes is realistic and sustainable.

?We?re on the home stretch now and I think the people of Colorado are going to get us all the way there. What do you think?,? Romney said, to roars from the crowd Tuesday. ?What you?re seeing across this country as we?ve had these debates and as Paul and I have gone across the nation, you?re seeing this movement growing.?

The GOP ticket appeared at the outdoor rally outside of Denver, where their signature ?R? logo reflected in the light on the enormous vertical rocks that surround the stunning venue. Polls are deadlocked in the state with both tickets within the margin of error. Ryan has spent three days campaigning in the state and ?Romney noted early voting here, which started Monday, asking people to cast their ballots early in order to help out?on Nov. 6th.

?There?s early voting now,? Romney said. ?You can take your ballots and send them in if you?ve got them. If you?ve got your absentee ballots be sure to send them in. If you haven?t got one get into the center and get sure that you get voted early. We want to get that done. We want to bank all those votes so on Election Day you can go out and get people to the polls that otherwise wouldn?t get there. Would you do that for me??

He thanked the audience, saying they are??helping change the course of a nation and setting the course on a path that will lead to greatness and prosperity again and again, that is the grassroots of America. That?s the people of America. That?s who we are tonight.?

Romney spokesman Kevin Madden told reporters earlier Tuesday that the campaign is feeling optimistic about its chances in Colorado.

?I think they?re all very close,? Madden said of the swing states. ?But we feel very, we feel very good about our prospects in Colorado.?

Before Romney and Ryan took the stage, the crowd listened to entertainers and Romney supporters Kid Rock and country star Rodney Atkins, as well as New Mexico Gov. Susana Martinez.

A vehicle this critical to the success of GM cannot fail. When the competition ups the ante, the Silverado must respond. Based on the American Ford F150 family of vehicles recent changes, and the truck offerings from the Italian company called Chrysler (still thought of as an American brand), we can predict what is to come. Fuel efficiency will be improved. To compete with the newest trucks Silverado will have to make gains. It would seem that unless GM has been hiding a big secret, Silverado will use cylinder deactivation and direct injection to make these gains. The horsepower race is over. The new spec sheet battle is over how many single MPG over 20 can the big trucks go. In-vehicle connectivity will also be highlighted. Finally, the Silverado will have a tough new look. Tough new look is required now for every truck maker, and has been for the last 3 or 4 generations of trucks. If your truck does not look like a Peterbilt in the rear view mirror of a Prius, it isn?t cool.

In a press release yesterday, GM did leak some style information. It told the public that the headlights of the Silverado will change. Who would?ve guessed! GM calls the new headlamps ?jewel-like projector beams.? This may be code for ?We are not going to do the LED thing.? If so, halleluiah, enough with the little shiny dots already.

Music Review: London Music Works and City of Prague Philharmonic Orchestra - Music from the Batman Trilogy

Most reviews to date are mixed regarding Music from the Batman Trilogy, a package of newly re-recorded selections from Batman Begins, The Dark Knight, and The Dark Knight Rises film scores. There are no complaints about the quality of the recordings, but, as with the original soundtracks, not everyone is enamored with the compositions by Hans Zimmer and James Newton Howard. It's worth noting that potential purchasers of Music from the Batman Trilogy might easily be confused by online listings for the album. Some sites credit only the London Music Works as the sole performance ensemble of these compositions; others say "Various Artists." To be specific, the London Music Works performs all but two of the selections. The two exceptions were recorded by the City of Prague Philharmonic Orchestra.

As most film buffs know, among his many credits, Zimmer scored The Lion King, Gladiator, Pirates of the Caribbean, and The Da Vinci Code. While being the junior partner for the Batman scores, Howard's resume is equally impressive, including music for Pretty Woman, The Prince of Tides, The Sixth Sense, and The Hunger Games.

Throughout the first two Batman films represented here, each composer was represented by both individual and collaborative passages, with Zimmer composing most of the action sequences, Howard the dramatic ones. Zimmer handled The Dark Knight Rises on his own. As a result, Music from the Batman Trilogy is largely a Zimmer show, with his work being roughly 2/3 of the material.

Of the five selections from Batman Begins, The City of Prague Philharmonic Orchestra only performs one track, Howard's elegiac "Eptesicus." The London Music Works presents the other four samples of somber drama. These include the main title "Vespertilio," "Barbastella" (where the Waynes are killed and Bruce discovers the cave), "Antrozous," And "Molossus," the last being the main action theme. (The titles come from Latin names for bats.) The entire suite is a low-register, moody undercurrent of strings, especially cellos, horn, and percussion settings that don't require the film's imagery to convey the themes of menace and danger.

For the Grammy-winning The Dark Knight, Zimmer and Howard expanded their ranges with more distinctly individual compositions. Again, The City of Prague Philharmonic Orchestra is represented by only one track, "Aggressive Expansion." Again, the London Music Works performs four sections, including the Joker's suite, "Why So Serious?," built on two notes played by electric cello, violin, guitars and a string section. They also do renditions of "Like a Dog Chasing Cars," "Introduce A Little Anarchy," and "A Watchful Guardian." In a sense, Howard takes a more traditional approach focused on strings and keyboards. Zimmer weaves in electric guitar, electronics, and timpani that punctuate as well as add emotional resonance to the Batman/Joker duel.

Finally, Zimmer is not only the sole composer for The Dark Knight Rises, the London Music Works performs all five passages including "Mind If I Cut In" (Selina Kyle's theme), "Fear Will Find You," "Why Do We Fall?," "Imagine the Fire," and "Rise." By this point in the saga, the musical themes were essentially recapitulations of what had been established in the previous two films. The major new material, music composed for the Bane character, isn't really showcased on this package.

Judging from the choices for this presentation, where The Dark Knight had expanded instrumentation to give the music more bite, The Dark Knight Rises was a more full circle score with a more pronounced symphonic sound. As a result, Music from the Batman Trilogy does feel like a complete musical experience that establishes themes, expands them, and then ties the threads together.

Without question, the Danny Elfman scores for the Tim Burton (and company's) Batman outings are far more memorable than the Zimmer/Hoffman compositions. It will be a very finite audience that will want Music from the Batman Trilogy, which should largely be listeners who don't already own all the official soundtrack albums.

Trilogy can't supersede the full soundtracks, but it isn't designed to do so. Rather, both orchestras consolidate the scores into a unified performance that will fill your speakers with what you remember from the theatre. If you liked what you heard then, you'll appreciate what you hear now. Just don't expect an Elfman-like musical ride that you can't get out of your head.

Mayor Gray Announces DC Streetcar Financing Governance Task Force

Mayor Vincent C. Gray today announced he has established a Streetcar Financing and Governance Task Force to advise him on potential sources of funding and forms of governance for the District of Columbia?s emerging streetcar system.

?The District has the most ambitious streetcar plan in the nation. We are the only city talking about putting down 37 miles of tracks,? said Mayor Gray. ?I want to make sure we have the best minds inside and outside the government working on the important issues of financing and governance to ensure the system has a firm foundation.?

The 14 member Task Force will be chaired by City Administrator Allen Y. Lew and will include 6 public members, appointed by the Mayor, with expertise in transportation systems design or engineering, public-private development partnerships, project financing and/or economic development.?

Mayor Gray today announced he has appointed Jair K. Lynch, President and CEO of JAIR LYNCH Development Partners to serve as Vice Chair of the Task Force. The other public members include Richard H. Bradley, the Executive Director of the Downtown DC Business Improvement District (BID); Charles C. ?Sandy? Wilkes, Chairman of The Wilkes Company; Matthew J. Klein, President of Akridge; Robert Puentes, a senior fellow with the Brookings Institution?s Metropolitan Policy Program; and Ginger Laytham, Senior Executive Officer to the President, CEO and Chairman of Clyde?s Restaurant Group.

The additional members include the Director of DDOT, the Deputy Mayor for Planning and Economic Development, the Director of the Office of Planning, the Chief Financial Officer for the District of Columbia, the Director of the Mayor?s Office of Budget and Finance, the Director of the Department of General Services, and the Director of the Department of Consumer and Regulatory Affairs.

The Task Force is expected to:

  • Provide detailed annual cost estimates for the construction of each portion of the 22-mile priority segments of the planned 37-mile streetcar system, including separate estimates of any streetscape or ancillary improvements associated with construction of the streetcar system;

  • Provide detailed annual cost estimates for the operation and maintenance of the streetcar system for at least the first eight (8) years of operation;

  • Examine potential sources of funds, including District capital funds, special assessments, tax increment financing, private investments, value capture mechanisms, and federal funds, for the construction of the streetcar system;

  • Examine potential financing options for the construction of the streetcar system, including options that minimize the impact of financing on the District?s debt cap;

  • Examine potential sources of funds for the operation and maintenance of the streetcar system, including District operating funds, special assessments, fare box revenue, advertising revenue, regional contributions, and federal funds;

?

  • Propose reasonable timelines for the construction of each portion of the streetcar system, based on the funding and financing models;

  • Examine potential forms of governance for the construction and operation of the streetcar system, including the establishment of an independent agency; and

  • Transmit to the Mayor written reports of its findings and recommendations.

Fans in Cyprus throw firecracker at injured player

NICOSIA, Cyprus (AP) - Fans of a Cypriot soccer club threw a powerful firecracker at one of its players while he was receiving medical treatment during a game.

The team, Anorthosis Famagusta, said no one was seriously injured.

Trainers were tending to Colombian forward Ricardo Laborde on Sunday. Video footage shows the trainers and Laborde writhing on the ground after the firecracker exploded inches from their faces.

Anorthosis Famagusta condemned the actions of its fans and also denounced those who lit flares during the league game against Omonia Nicosia.

Anorthosis, which is tied for first place, urged police on Monday to check fans more thoroughly when entering the stadium. Police said investigators are studying television footage to track down the culprit.

Assad tells Syria envoy arms flows to rebels must stop

DAMASCUS (Reuters) - A car bomb killed 13 people in central Damascus on Sunday as President Bashar al-Assad told an international mediator seeking a truce in Syria's civil war that the key to any political solution was to stop arming rebels.

The bomb exploded outside a police station in the mainly Christian central Bab Touma district of the capital while Assad held talks with United Nations-Arab League envoy Lakhdar Brahimi, who is pushing for a temporary ceasefire to mark the Islamic festival of Eid al-Adha.

State news agency SANA said the president said Syria supported "any sincere effort to find a political solution to the crisis, based on respect for Syrian sovereignty and rejecting foreign intervention."

Any proposal "must be centered around the principle of halting the terrorism and ... commitment by the countries involved in supporting, arming and harboring the terrorists in Syria to stop these actions", SANA quoted Assad as saying.

Syrian authorities blame neighboring Turkey in particular for the bloodshed because it has sheltered mainly Sunni Muslim rebels fighting to overthrow Assad, from Syria's Alawite minority which is an offshoot of Shi'ite Islam. Gulf Sunni powers Saudi Arabia and Qatar also support arming the rebels.

Syria's conflict, which started with peaceful protests for reform, has escalated into a civil war marked by heavy use of artillery and air power by Assad's forces and regular bombings against symbols of his authority in Syria's main cities.

The Interior Ministry said the Bab Touma bomb, on the edge of the old city of Damascus, killed 13 people. Security forces cut off access to the area. Television pictures showed shattered glass on the road and several burnt out cars.

HOPING FOR CALM

Speaking after his meeting with Assad, Brahimi gave few details of the talks but reiterated his call for a pause in the violence, which activists say has killed more than 30,000 people since the uprising against Assad erupted in March last year.

"Everyone can start this (ceasefire) when they want, today or tomorrow for example, for the period of the Eid and beyond," he told reporters at a Damascus hotel. Eid al-Adha begins at dusk on Thursday, lasting for three or four days.

Brahimi said he had contacted opposition figures inside and outside Syria, including rebel fighters, as well as officials in neighboring countries, some of which support the insurgency.

"They answered that they would respond positively to a (ceasefire) initiative from the government," he said. "We hope this Eid in Syria will be calm, even if it is not a happy Eid."

He added: "If we do find that this calm continued through the Eid, we will try to build on it. If that does not happen, we will try nevertheless and work to open the path to hope for the Syrian people."

Turkey has called for all sides to observe Brahimi's truce. Iran, one of Assad's major backers, has also supported the call but said the main problem in Syria was foreign interference, such as arming the rebels.

The United States, which has been a vocal critic of Assad but has little apparent influence on the ground, threw its weight behind the ceasefire call on Friday.

A previous ceasefire in April collapsed after just a few days, with each side blaming the other. Mediator Kofi Annan resigned his post in frustration a few months later.

The violence has spread across Syria's frontiers. Assad's forces exchanged cross-border artillery fire with Turkey several times this month and on Friday a huge car bomb in Beirut killed a top intelligence official whose investigations had implicated Syria in trying to stoke violence on Lebanese soil.

Syria's Information Minister Omran Zoabi told reporters on Friday: "We condemn this terrorist explosion and all these explosions wherever they happen. Nothing justifies them."

Boston Schools Hailed For Fighting Childhood ObesityYour Health ...

Four Boston Public Schools are being honored by former President Bill Clinton for their efforts at instituting healthy eating programs, but overall the state still has a ways to go before making a significant dent in the number of children who are obese or overweight.

Clinton and the Alliance for a Healthier Generation awarded Bronze National Recognition Awards to Richard J. Murphy K-8 School, the Kennedy Health Career High School, the Tech Boston Academy and William E. Russell Elementary School.

The achievements are the result of an alliance between BPS and the Alliance that was formed in 2007. In all, more than 100 schools participate in the program.

Murphy School was honored a health snack cooking class and instituting employee wellness programs that included Weight Watchers. Kennedy High School increased the number of healthier vending machine options in the school, created more fitness classes as well as those dedicated to health education. The Tech Academy worked with BPS Food Services and local farmers to include more fresh produce in their lunch program. Russell Elementary, meanwhile, made changes to their physical education program to add more vigorous physical activity.

?When the Alliance for a Healthier Generation approached us in early 2007 it was perfect timing because we were doing this kind of work but we didn?t have the capacity to work with all schools.? said BPS Health and Wellness Department Executive Director Jill Carter. ?This program put it on the web and gave us the systematic framework. We were well positioned to take it and run with it.?

Overall, however, Boston and Massachusetts still lag behind much of the nation in combating childhood obesity. The state ranked 21st in the number of overweight and obese children in 2003. In the most recent ranking, Massachusetts fell one spot to 22. Nationally, the percentage of children 10-17 years of age who are obese overweight is 31.6 percent, while in Massachusetts it stands at 30 percent. Finally, Massachusetts spent an estimated $1.8 million in medical expenditures to treat obese adults from 1998 to 2000, while nationally, approximately $75 million was spent.

Oh No They Didn&#39;t! - Dish Network Settles Suit With AMC

Dish Network Corp. settled a long-running lawsuit with AMC Networks in a deal that will return AMC's channels to Dish's satellite lineup after nearly four months, the companies said.

As part of the settlement, Dish will pay $700 million in cash to AMC and its sibling company, Cablevision Systems Corp. Included in the total is $80 million for Dish to purchase wireless-spectrum licenses from Cablevision, the companies said.

In the suit, which dates back four years, AMC's Voom unit had sued Echostar Communications Corp., now known as Dish, for breach of contract over Voom's now-defunct suite of high-definition TV channels. Voom claimed damages of $2.5 billion.

That legal dispute was complicated when Dish dropped AMC's channels from its satellite TV lineup at the end of June, citing the high programming cost of the channels relative to their low viewership. AMC said at the time that the blackout was related to the Voom lawsuit.

Dish will resume carrying AMC channel, which airs such popular shows as "The Walking Dead," effective Sunday. The satellite operator will resume carriage of AMC's other channels, Sundance Channel, IFC and WE tv, on Nov. 1. Dish is also adding back the Fuse music channel, owned by another AMC sibling company, Madison Square Garden Co. which has been off Dish's service since 2010. The companies said Dish had entered into a long-term distribution agreement for the channels.

The deal "delivers a fair value for both parties," said Dave Shull, Dish senior vice president of programming, in a statement. AMC Chief Executive Josh Sapan said in a statement, "We are glad to partner again with Dish."

Speculation that settlement talks were under way emerged late last week after the judge hearing the case adjourned trial proceedings shortly before Dish Chairman Charlie Ergen was due to testify. Proceedings in New York State Supreme Court were set to resume Monday.

Both companies had reason to resolve the programming dispute. Dish has 14 million subscribers, about 13% of AMC's potential audience, so the blackout was depriving AMC of a sizeable chunk of its possible audience at a time when "The Walking Dead" was drawing big audiences. The second episode of the latest season of that drama was due to air Sunday night.

Dish, meanwhile, was under pressure from subscribers to restore the AMC channel. Its Facebook page was flooded with complaints from customers unhappy that AMC wasn't available.

Dish had also been on the defensive in the trial, coming under criticism from the judge, Richard B. Lowe III, who said at one point that the company had "no credibility when it comes to document exchange and turning everything over." Ten days ago the judge granted AMC the right to hire a forensic team to examine Dish's computer hard drives for any deleted draft copies regarding a 2007 audit Dish undertook of the Voom channels.

In proceedings in November 2010, the judge had ruled that the satellite provider systematically destroyed emails relevant to the case within a reasonable period of expecting that the dispute would go to court.

Leyland says?Valverde will be ready for Series

DETROIT (AP) - Jose Valverde threw a few pitches during Detroit's workout, then returned to the dugout as upbeat as usual.

Valverde's role for the World Series still isn't clear, but the right-hander doesn't seem to mind.

"I don't care. All I want is to be a champion," he said. "If I had to start, I'd do it."

Valverde has been Detroit's closer for three years and didn't blow a save through all of 2011, but this postseason has been ugly. He lost Game 4 of the division series against Oakland and gave up four runs in the AL championship series opener against the New York Yankees. The Tigers went on to win that game and sweep the series, but Valverde hasn't been used since.

The World Series begins Wednesday at either St. Louis or San Francisco. Valverde sounds confident he's made the necessary mechanical adjustments, and so does manager Jim Leyland.

"I think everybody's making too big of a deal of the Valverde situation. Valverde's going to be ready. There's nothing wrong with Valverde. He's going to be fine," Leyland said. "I got a kick out of it. Nobody wanted me to pitch him, but everybody asks me every day if he's going to be the closer. I don't know what they expect, but I'm going to just see what happens."

Leyland went with other options after Valverde's meltdown against the Yankees. Left-hander Phil Coke got the save in Games 2 and 3.

The more flexible approach to the late innings allowed Leyland to use Coke in crucial spots against a New York lineup that has plenty of left-handed power. Against the Cardinals or Giants, Valverde might be back in his old role. Aside from Coke, Detroit's top relief options include right-handers Joaquin Benoit, Octavio Dotel and Al Alburquerque. Benoit has had difficulty keeping the ball in the park this season.

"Sometimes the biggest out is in the seventh inning or eighth inning, not always in the ninth inning," Leyland said during the series against New York. "That's why when you start going by committee, that's what `committee' means. You say, `This is the most important out I have to get. I will use my bullet now and take my chances later."'

Still, Leyland sounds ready for Valverde to contribute again.

"To me, you've got to pinch hit in the National League cities, you're going to have to use your pitchers, so if you get behind, that's just the way it is," Leyland said. "I think he'll be a big part of this World Series."

Coke, meanwhile, has been in the spotlight more than usual, and he's certainly enjoying the ride.

"I don't have any idea what's going on. I just know I'm having a good time," Coke said recently. "And we have a common goal that we're trying to achieve, and the last thing I want to be known for is the one that didn't do his job."

Coke's performance probably earned him a bit more leeway with Leyland. The manager didn't seem to mind the fact that Coke accidently nicked him on the head with a bottle during the postgame celebration after the finale against the Yankees.

"That was just Phil Coke pouring champagne. I got real cold. I usually don't go out in those celebrations. But they got me, and I was freezing, so I jumped up and he was - as Phil Coke will do - he kept dousing the thing," Leyland said. "Well, as he poured the bottle down, I jumped up. Well, he hit my bald spot in the back, split my head open, but fortunately it was just a big scab. It didn't slice it open. I didn't need stitches or anything. After a couple more vodkas and cranberries, I didn't feel anything."

It's been a trying year at times for Leyland, who admitted his team underachieved for much of the season. But now Detroit is ready for a chance to shine on the game's biggest stage.

"I can't tell you how many free meals I've had in the past 24 hours. I'm almost embarrassed, but every time I go to pay a check they said somebody picked it up," Leyland said. "They've been great, really neat, in the grocery store and stuff everybody's pumped up obviously."

This week (October 15-21) has seen its due number of happenings within the country and beyond insofar as the IP scenario is concerned, with 8 posts having been put up in the blog, covering a varied range of events.

Guest Post on Xerox Victory

?

It started with a guest post by Adarsh Ramanujam, an IP lawyer, analyzing the impact in the Indian trademark law scenario of the judgment Ilango v. Rank Xerox Ltd. & Ors., wherein Xerox Corporation has won a significant victory before the IPAB in preventing ?Xerox? being declared a generic mark and hence invalidating the trademark protection currently accorded to it. The factors that the IPAB had considered to reach its decision include ?public acceptance of the trademark rights? of the Xerox Corporation, ?long continuous existence on the register?, which was uncontested by competitors and the presence of alternative words like ?photocopy? to describe the goods/services involved. Curiously enough, throughout the judgment, no reference has been made to the existing legal provisions, such as S. 9(1) of the Trade Marks Act, 1999, which one would have thought had a close bearing in the determination of whether the trademark should remain on the register or otherwise.

Guest Post on TRIPS-Compliance of Bayer-Natco Decision

This was followed by another informative guest post by Dr. Enrico Bonadio, an IP attorney and a lecturer of IP and EU law at The City Law School University, London, who sought to determine the TRIPS-compliance of the recent Bayer-Natco decision involving India?s first compulsory license of a patent. This post went on to analyze the Controller?s decision to interpret the ?local working? (or lack thereof) requirement to be satisfied for compulsory licensing, as to mean nothing short of local manufacturing and not merely local importation, with reference to S. 83(b) of the Patents Act. However, Dr. Bonadio opined that a combined reading of A. 31 and A. 27(1) of the TRIPS would reveal that where national legislations impose a local working requirement, patentees should have the possibility of satisfying such requirement by showing to have imported locally the patented product. Nor could Paragraph 5(b) of the Doha Declaration be invoked to justify the need of a local production requirement and hence a question remains regarding the degree to which the Controller?s decision is compliant with TRIPS requirements.

Internet Fraud by Fake Open Access Journals

The rising trend of the crime of internet frauds by way of soliciting papers for Open Access Journals was then brought into light by Mathews, who went on to lay down the provisions of the Information Technology Act, 2000 and the IPC applicable to such a crime. The practice essentially involves people sending mails on behalf of an Open Access Journal to researchers and scientists soliciting manuscripts, enticing the latter by keeping the processing fee low and the processing time quick, while in reality, such journals do not exist.

Sugen?s Efforts to save Sunitinib Patent

Prashant then carried a post reflecting the rather grim state of affairs in India?s still-ongoing struggle to come to terms with the basic of post-grant patent oppositions, as reflected in Sugen Inc.?s desperate attempts to save its patent for Sunitinib that had recently been revoked by the Patent Office. Not only has Sugen filed a writ petition before the Delhi High Court asking for the revocation to be set aside on the rather flimsy ground that a copy of the report of the Board of Oppositions has not been made available to Sugen, what?s even more astonishing is that, based on this petition, the court has then proceeded to restrain Cipla from releasing its generic drug in the market, which essentially amounts to an interim injunction against a private party, through a writ petition. The matter is due to be heard by a Single Judge on December 6, 2012.

This was followed by a post by Kruttika, referring to the manner in which, the Delhi High Court?s decision of disallowing the use of the word Bata in a disparaging manner in a song of Prakash Jha?s new movie Chakravyuh, was overruled by the Division Bench of the same court. Bata had contended that the use of its trade name in the context of this particular song laced with inferences about inflation, corruption, greed and exploitation by big corporate houses would lead the listener to view Bata in a negative light. However, the DB agreed with the opponent?s contentions that the use of the trade name in the song was rhetoric hyperbole and merely referred to the socialist and political struggle between the haves and the have-nots that the film is based on. Therefore, it was not a matter of defamation.

Copyright Office?s Errors with Register of Owners

Next came another post by Prashant, highlighting the manner in which the Copyright Office had erred previously in not insisting that the Indian Performing Rights Society, once having been registered as a copyright society, submit a Register of Owners as required under the prevalent rules. The register, detailing the list of persons who owned the copyright in works being administered by IPRS, was the only way in which the identity of the people, who could control IPRS, could be legally ascertained. With the Copyright Rules, 2012 being just around the corner and the Copyright Office gearing up to register new copyright societies, Prashant?s observation was of particular significance, lest the old errors be repeated once again.

Controller?s Decisions in September, 2012

Rajiv then posted his latest data compilation of the Controller?s decisions for the Month of September, 2012. Out of the 94 decisions, 46 patents were granted, 33 refused (including abandoned and withdrawn) and no file uploaded for the remainder (15).

Petitions and Developments in the DU Copyright Controversy

Finally, it was Amlan?s turn to highlight the latest developments in the contentious copyright battle between Delhi University and a group of publishers. Unfortunately, as time is passing, the university may be showing signs of distancing itself from the photocopier and may not be resisting the suit with all diligence. Amlan has also referred to a petition available on Change.org that urges the publishers to drop the suit, which is gaining momentum rapidly.?

Apple loses UK Battle against Samsung

One of the biggest news of the week is definitely Apple?s loss in the UK lawsuit, where a three-judge panel in London upheld an earlier decision by a U.K. court that said several of Samsung?s Galaxy tablets weren?t ?cool? enough to be confused with the iPad and hence cannot be held to cause infringement of the latter?s designs. This is the latest in a series of rulings all across the world that have puzzled IP enthusiasts owing to their inconsistencies, with US deciding in favor of Apple and Tokyo, Australia and Netherlands favoring Samsung?s arguments.

Monsanto suspends Royalty Collection from Brazil

Meanwhile, Monsanto Co., the global seed production giant, has suspended collection of royalties for its Roundup Ready soybeans in Brazil, while it appeals a state court ruling in Mato Grosso, which had agreed with a group of growers that a patent on first-generation Roundup Ready soybeans had expired and halted royalty payments in the state.

Viacom Trademark Dispute gets settled

The trademark dispute between Viacom Inc. and DJ Paulie [Paul Lis DJ Paulie Broadcasting LLC v. Paul DelVecchio Jr.] regarding the latter?s objection to names used in connection with a character from MTV?s ?Jersey Shore? reality television program, has reached a settlement, although the full terms are yet to be disclosed.

Trade Secret Misappropriations: Even Bulletproof Kevlar is not Spy-proof

Groves, the District Court at Kentucky is holding a trial of three former employees of White Drive Products Inc., who have been accused of trade secret misappropriation of the hydraulic-component manufacturer and handing them over to a competitor as part of a plan to be hired by the new company.? In a set of similar events, Kolon Industries Inc. and five of its executives have also been charged with stealing trade secrets from DuPont Co. related to the manufacture of Kevlar, an anti-ballistic fiber used in police and military gear. The trial is being held in the District Court at Virginia as U.S. v. Kolon Industries.

Williams Pharmacy (referred to during last week?s review), VF Corp.?s North Face unit has managed to force the defendants in a previous trademark dispute with the makers of ?South Butt? DIGITALEUROPE accused of hijacking Mediation Process for having advocated Reforms

On another front, copyright collective management and creators? organizations have recently accused the digital technology industry group DIGITALEUROPE of trying to hijack a mediation process aimed at straightening out the EU?s messy system of private copying and reprographic levies. DIGITALEUROPE, in a recent paper setting out alternatives to device-based copyright levies, had urged the European Commission to initiate comprehensive reforms that include replacing levies with some other forms of compensation to rights holders.

USPTO set to update Code to conform with ABA Norms

In a much-awaited move, the USPTO has finally announced its proposal to update its Code of Professional Responsibility to conform to the Model Rules of Professional Conduct of the American Bar Association. The proposed package imbibes most ABA provisions with minor or no revision and codifies professional obligations already applicable to legal practice. The rules also propose to do away with the annual practitioner maintenance fee, which would no doubt be a popular move.

WIPO moves closer to the Treaty for the Visually Impaired

On a bit of welcoming note, WIPO members have, over this week, inched a little bit closer to the much-awaited Treaty for the Visually Impaired, an international instrument facilitating access to copyrighted reading and educational material in special formats for visually impaired persons, through a set of exceptions and limitations to copyright. After three days of mostly informal discussions and a set of succeeding draft texts, the WIPO members finished on October 19 with a more agreeable draft, while identifying a few more areas where more work needs to be done.

US Universities? Digitization move gets supported by Court

On a similar line of development, the US District Court of New York took the side of the universities running the cutting-edge HathiTrust project to establish a repository to archive and share the digitized collections of partner institutions, particularly for purposes of full-text searches, preservation and access for people with print disabilities. The universities won the copyright infringement suit brought against them, as the court permitted their actions under the fair use doctrine as per Section 107 of the US Copyright Act.

In IP we trust: Church approves of IP Rights

Yet another fascinating event is the recognition of IP rights by none other than the Archbishop Silvano M. Tomasi, who at the recent General Assemblies of the World Intellectual Property Organization in Geneva, opined in an interview that the church finds ?human value? in IP and, as the latter protects and promotes innovation and creativity, it is good for humanity.?

Philippines not happy with US Special 301 Report

The Special 301 Report (identifying countries that deny adequate and effective protection of IP rights) published by the US Trade Representative was once again criticized, this time by the IP authorities in Philippines, who alleged that the retention of the country in that report despite significant progress having been made in curbing piracy and protecting IP rights has resulted in low morale amongst the enforcers. This in turn has caused the total worth of seized counterfeit products by government anti-piracy agencies for the first nine months of the year to fall 18% to P 4.12 billion from P 5 billion a year ago.?

Malaysia ready to unveil IP Valuation Model

On an interesting note, The Multimedia Development Corp in Malaysia is set to unveil the highly anticipated IP valuation model in December, 2012, which is being perceived as the first step in assisting financial institutions to refer to a specific methodology in valuing IP rights, with an ultimate goal of securing recognition of IP rights by financial institutions as a collateral asset.
